E-cigarettes, which have been under discussion in recent years, are expected to be formally regulated soon. Today (March 22), the Ministry of Industry and Information Technology of China issued a draft for comments on this issue.
The "Decision on Amending the Implementation Regulations of the Tobacco Monopoly Law of the People‘s Republic of China" issued by the Ministry of Industry and Information Technology has only one paragraph:
An article has been added to the supplementary provisions of the "Regulations on the Implementation of the Tobacco Monopoly Law of the People‘s Republic of China (Draft for Comment) as Article 65: "E-cigarettes and other new tobacco products shall be implemented with reference to the relevant regulations on cigarettes in these regulations."
To this end, the Ministry of Industry and Information Technology explained that it is mainly based on the following considerations:
(1) Promote the legalization of e-cigarette supervision. In recent years, there have been some new situations and new problems in the market supervision of new tobacco products such as e-cigarettes, and all aspects of society have paid great attention. This revision is mainly to implement the requirements of the Party Central Committee and the State Council on advancing the legalization of e-cigarette supervision, clarify the legal basis for the supervision of new tobacco products such as e-cigarettes, and do a good job in compliance with laws and regulations such as the Law of the People’s Republic of China on the Protection of Minors Convergence, to play the important role of the rule of law to consolidate the foundation, stabilize expectations, and benefit the long-term.
(2) Comply with the characteristics of e-cigarette products and current international regulatory practices. In view of the homogeneity of new tobacco products such as e-cigarettes and traditional cigarettes in terms of core components, product functions, consumption methods, etc., new tobacco products such as e-cigarettes should be implemented in accordance with the relevant regulations on cigarettes in the Implementation Regulations. This is also consistent with the supervision of new tobacco products such as e-cigarettes in major countries and regions in the world.
(3) Enhance the effectiveness of e-cigarette supervision. The implementation of new tobacco products such as e-cigarettes with reference to the relevant regulations on cigarettes in the "Implementation Regulations" will greatly improve the effectiveness of e-cigarette supervision, effectively regulate e-cigarette production and operation activities, and solve the product quality and safety risks of e-cigarettes, false advertisements, etc. Problems, and effectively protect the legitimate rights and interests of consumers.
